Everyone at GLAWKER is upset by the prospect of the Supreme Court accepting an abortion case for review and the prospect of the conservative leaning Supreme Court overturning Roe v. Wade. There are certainly a lot of things regarding Roe that are worth discussing. Beyond it's cultural and moral implications, Roe also has profound implications regarding the proper role of the Supreme Court.
In the last two days, JoePa has twice predicted (admittedly possibly in jest) that the Supreme Court is set to "ban" abortions overturning Roe v. Wade. This is, of course, silly. If Roe v. Wade is overturned, it will once again be up to the voters in each state to decide whether to allow abortion. The likely result will be that some states, such as California and New York will allow abortion with virtually no restrictions and some states, like Mississippi and Utah will completely ban abortion. The rest will probably be somewhere in between.
So, my question is this: Is JoePa so stupid that he doesn't know how the whole Federalism thing asctually works? Or is he just being intellectually dishonest in order to scare ignorant people into believing that the stakes here are different than they really are?
