Kirkland & Ellis Backs Away From (Some) Constitutional Rights

“Unfortunately, we were given a stark choice: either withdraw from ongoing representations or withdraw from the firm,” Mr. Clement said. “Anyone who knows us and our views regarding professional responsibility and client loyalty knows there was only one course open to us: We could not abandon ongoing representations just because a client’s position is unpopular in some circles.”

Nice to know that if your case or cause become disfavored by the Democratic Party, Kirkland will drop you like a hot potato.  

Is it just me or is this a totally unworkable posture for a law firm of this size?  Some of the cases I or my employer have been involved in have gotten... media attention, not always positive on the left.  I do actually select outside counsel on potentially significant matters, including BigLaw at times, and this profoundly influences me in the negative.  Not because I'm pro-gun (though I am), but because the firm being obviously politically influenced in a way that could affect my representation is totally unacceptable.  Frankly I'm shocked they would do it, not a good look IMHO.

Holly shit, Roe overturned by SCOTUS

 

"The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives," a syllabus of the opinion said.

"The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely — the Due Process Clause of the Fourteenth Amendment," Alito wrote. "That provision has been held to guarantee some rights that are not mentioned in the Constitution, but any such right must be 'deeply rooted in this Nation's history and tradition' and 'implicit in the concept of ordered liberty.


Justice Roberts  joined the majority.

 “…at 12 weeks the “unborn human being” has “taken on ‘the human form’ in all relevant respects.” §2(b)(i) (quoting Gonzales v. Car- hart, 550 U. S. 124, 160 (2007)). It found that most abor- tions after 15 weeks employ “dilation and evacuation proce- dures which involve the use of surgical instruments to crush and tear the unborn child,” and [the legislature] concluded that the “intentional commitment of such acts for nontherapeutic or elective reasons is a barbaric practice, dangerous for the maternal patient, and demeaning to the medical profes- sion.” 

Going through the opinion I find it methodical in pointing out the logical defects in Roe and Casey. 

It’s pretty irrefutable that Roe never should have been decided.

In plain English no less.

Napa DA charges Paul Pelosi with DUI causing injury

 

The other shoe just dropped following the DUI arrest of Speaker Pelosi’s husband 5 miles from their wine country estate.

As noted in the article, Pelosi’s late model 911 collided with a Jeep causing its driver injury. Pelosi’s blood test, however, put him just a teeny bit over the legal limit, namely a .082, making the trial a cakewalk for defense attorney John Keker. Especially since nobody died.

The two charges include: driving under the influence of alcohol causing injury, and driving with a .08% blood alcohol level or higher and causing injury, according to a Napa DA press release.  

The California Highway Patrol reported at the time that Pelosi was driving a 2021 Porsche east on Walnut lane across Highway 29 when his vehicle collided with a 2014 Jeep on Oakville Cross Road at 10:17 p.m. A blood sample taken from Pelosi at 12:32 a.m. found that Pelosi’s blood sample had a .082% blood alcohol content according to a California Department of Justice test, the DA's press release says.  test, the DA's press release says.

Avenatti to unilaterally plead guilty in CA fraud case, asks for setencing



 The only thing that occurs to me is that Avenatti thinks he can get a better result by simply pleading guilty and accepting what the court gives him by way of a sentence than accepting a plea deal acceptable to the government. But (an anticlimactic) wow!

"Mr. Avenatti wishes to plea in order to be accountable; accept responsibility; avoid his former clients being further burdened; save the court and the government significant resources; and save his family from further embarrassment," the court filing said.
